Are you aware of birds protected by CITES. I am sure they would be interested by what your doing with some of these protected
species of pheasants, Edwards is CITES 1.

wether it is against some law you think you Know or not this sounds just like a crybaby post from a competitor seller I am sure he can work out the legal aspects on his own.
What did you wish to accomplish by a post like this? if it was to inform this seller then it should have been handled in a PM like the rules of the Forum instruct! Read the very top post on the Forsale

Jeff Thanks for your concern but apparently you don’t have any idea about what you are talking about  the MBTA (Migratory Bird Treaty Act in case you don’t know what that is) doesn’t apply to pheasants. CITIES only covers importing or exporting out of country so it does not apply either so If you think you know more than Peggy Labonte
Legal Instrument Examiner of the Federal government let’s hear it.

So to everybody else just make sure it’s legal to purchase in your own state anybody want to purchase an awesome Edwards Pheasant.  As long as your as state allows live or dead birds



ALSO PLEASE PM ME IF ANYONE HAS SOMETHING TO SAY TO ME! SO WE DONT HAVE A WHOLE DISCUSSION ON THIS BOARD...I WOULD HAVE NEVER DONE ANYTHING IF YOU SENT ME A OM OR EMAIL INSTEAD OF POSTING WHAT I CONSIDER A THREAT!!

Pheasants are on the CITIES for importation and exportation into the united states this is neither he is selling "Pen Raised" birds within the states so how does that apply?
Secondly I disagree he knows what his legal aspects are of selling his birds just because someone thinks they know more than they do and throws a threatening post up and possibly discourages any sales should not be put into this post.
Thirdly anybody that is interested in buying some of these exotics should be checking into the legalities of the purchase on their own anyway.

I thought criteria for CITYS 1 was based on the range in the wild and not in captivity, but 100% sure.

Cities is for importing or exporting birds from country to country...Not for pen raised birds that have been bred in captivity for many years!!


My thoughts even not being a taxidemist,if it wasn't for some of these guys many years ago that stuffed animals that are now extinct,we would never even know what they would have looked like,except for drawings or maybe a picture if we were lucky!


Sp more power to all you fine taxidermist who can capture the real life of animal for future ones to enjoy!!

Here is what regulations 50 CFR 17.22 Pheasants states and if you read this it states that you may legally sell these birds alive.  The last section (ii) states they may not be sold across state lines once they are DEAD

EXCERPT:  ....(6) Any person subject to the jurisdiction of the United
States
seeking to engage in any of the activities authorized by paragraph
(g)(1) of this section may do so without first registering with the
Service with respect to the bar-tailed pheasant (Syrmaticus humiae),
Elliot's pheasant (S. ellioti), Mikado pheasant (S. mikado), brown eared
pheasant (Crossoptilon mantchuricum), white eared pheasant (C.
crossoptilon), cheer pheasant (Catreus wallichii), Edward's pheasant
(Lophura edwardsi), Swinhoe's pheasant (L. swinhoii), Chinese monal
(Lophophorus lhuysii), and Palawan peacock pheasant (Polyplectron
emphanum); parakeets of the species Neophema pulchella and N. splendida;
the Laysan duck (Anas laysanensis); the white-winged wood duck (Cairina
scutulata); and the inter-subspecific crossed or ``generic'' tiger
(Panthera tigris) (i e., specimens not identified or identifiable as
members of the Bengal, Sumatran, Siberian or Indochinese subspecies
(Panthera tigris tigris, P.t. sumatrae, P.t. altaica and P.t. corbetti,
respectively) provided:
    (i) The purpose of such activity is to enhance the propagation or
survival of the affected exempted species;
    (ii) Such activity does not involve interstate or foreign commerce,
in the course of a commercial activity, with respect to non-living
wildlife;
