A copy of my contract for folks with questions.

I see a lot of people asking about contracts.  I just had this drawn up and thought I would share mine with some of you that had questions about what should be in them.  You may want to add to it and it may not be legal verbage in everyones state but it is a guideline some could possibly follow.  Hell who knows someone may find something wrong with mine that needs to be fixed.



TAXIDERMY CONTRACT



I, (name) _____________________________________ am entering an agreement with Darrell Hall for taxidermy services on this (animal) ___________________________.  In this agreement I understand that “Darrell Hall” refers to himself and any of his family or agents and that “I” refers to myself or anyone representing me as the customer.  I state that this animal was harvested legally in the state and or county that it was taken.  I also state that all legal methods of transfer have been done to this point of transfer to Darrell Hall.  This (animal) ___________________  also known in this document as specimen and/or wildlife resource is in the following condition when delivered to Darrell Hall (circle all that apply) frozen, whole, frozen head in, caped, salt dries, air dried.  I understand that upon inspection by Darrell Hall additional charges will be applied to the quoted price for the following: cut throats, excessive freezer burn (to the extent that it can not be re hydrated) or other reasons deemed necessary by Darrell Hall.  Darrell Hall agrees that none of these charges will be applied until I am contacted either by phone and/or mail.  I understand that Darrell Hall is not liable for the damage and/or condition of my specimen caused by myself or any one representing me and/or my outfitter.  I understand that at any time during the taxidermy process that Darrell Hall may discontinue work on my specimen if he feels that the project was mis handled prior to delivery to him.  I understand that upon such findings I will be notified and given the option to come and pick up specimen and/or a replacement specimen or part (if legal) may be obtained at my expense.  I understand that in the event I choose to pick up the specimen my deposit may be forfeited to cover expenses to that point.  I understand that additional charges may be applied if appropriate to cover costs.  I understand that prior to any work beginning a 50% deposit has to be paid to Darrell Hall.  I understand that this deposit may or may not be refundable in the event Darrell Hall does not complete this specimen.  I understand that I will be contacted 2 weeks prior to my specimen being completed.  I understand that the balance will be due upon completion and before my specimen can leave Darrell Hall’s property.  I understand that a $10.00 per week storage fee may be applied to specimens left over 30 days and that for specimens left over 60 days Darrell Hall has the right to recover his expenses by what ever means that the laws of the State of Texas allows him to.  I understand that the estimated time for this specimen project has been quoted by Darrell Hall is _______ days.  I understand that this is a good faith estimate and is in no way a guarantee of my specimen being complete in that time.  I understand that Darrell hall is not responsible for loss or damage to my specimen by events out of his control.  I have read and understand this agreement and have no unanswered questions or concerns.  I agree to these terms and prices quoted and agree to leave this wildlife resource and/or its parts with Darrell Hall. How much of the information is duplicated for your state tags?  In Michigan, the hunters info and species info are all on the state tag.  I think for us the contract is best if it is kept to the work being done and the liability.  It seems to take so long to fill out everything as it is.  But it looks good to me.

Here is mine... Also the reason I list everything that is on the tag is so that you can show DFG that everything is in order, you know what goes with what and where it is.  You can match paperwork with hide, and antlers.. or whatever..

Mounting Instructions.
 Please indicate pose,if you want a wall plaque added or habitat, etc.. Lifesize mounts come with a basic stock base. Custom bases, habitat's, and plaques are optional and not included in the price of the mount.  If you wish to have a custom base or habitat added please indicate what you would like, be specific and detailed. Crating, shipping, repair, form modification to fit short capes, skinning, and the replacement of capes/skins, and outside tanning is extra. In house tanning is only avail for certain species and is at the discretion of the taxidermist.

Tanning is at the risk of the customer. Royal Oaks Taxidermy is not responsible or liable for any damages or loss that may result from tanning whether its done in house or sent out. Tanning costs vary for outside tanneries and will be added to the final cost of the mount.

Crating, shipping, repair, form modification to fit short capes, replacement of capes/hides, skinning, fleshing, and cleaning and washing of skins not properly cared for is extra. 

AGREEMENT TERMS AND DEPOSIT

All Payments are to be in US dollars. At least 30% deposit required at time of drop off, 50 to 75% required on estimated amounts for African and other exotics. Certain circumstancesmay require the work to have complete cost paid in advance before work will begin or before it is finished and the customer will be notified if this is required. Bears require 50% deposit paid before work will begin, 25% withen 60 days,  and the remaining balance is due prior to completion.

Payments may be paid through Paypal to "RoyalOaksRanch@aol.com. Credit cards are also accepted through paypal.
Customer agrees to pay the balance due and pick up the mount withen 14 days of notification of completion. Its is agreed that notice of completion will be given by phone or email. After 14 days, a 5.00 per day storage fee will apply. If the mount is not paid for and picked up withen 30 days of notice of completion, all monies and mount will be forfeited and the mount will be sold or disposed of.

If final payment is made when picking up the mount it must be CASH. This means no checks.

Rae *****  and/or Royal Oaks Taxidermy will not be responsible or liable for theft, fire, flood, vandalism, hair slippage, or any other loss or damage. _________initial.

The customer agrees to pay for any cost or expense including any and all legal expenditures, collection enforcement costs, or any other costs associated with with customers work/specimen.
There is a 500.00 fee for any third party involvment plus other fees and costs as necessitated. Return check fee is 25.00 or three(3) times the amount of the check, whichever is greater plus other charges allowable under State and Federal law. The decision and discretion of the taxidermist is binding and absolute and shall apply in any situation in any disagreements or conflicts, and for fee assessment. No Cash refunds for any reason. Unsatisfactory customer prerformance may be reported and listed with credit bureaus, data banks, and collecton agencies and additional actions may be taken. ___________initial.

Thanks for the info.  I am drawing one up now, and this works perfectly into mine.  Since I only do Skulls, it will differ but still a GREAT example
