Ok I know from reading the archives that this is a touchy subject but,as a beginner i am starting to accumulate some mounts that i have practiced on. These are animals that i have bought and so I decide the other day to put a mandarin on Ebay to try and get my cost of the bird and materials back.Now this is not the best looking mandarin on Ebay by far{but Nancy M criticed it for me and i know i will do better next time,Thanks nancy:)}so i set the reserve at $40...ANYWAY...I get an email from them yesterday saying that they have taken it off because the only waterfowl you can sell are pen raised mallards with paper work. But I go on all the time and see Mandarins,teal and others for sell{much better than mine BTW}.He has a pic of the federal paper work with the birds, now i didnt get any paper work cause the breeder said i didnt need one.So my question is if I go back to the breeder and get the P/W can i put it back on?Dont want to get in trouble here!

If you are going to sell waterfowl, it better have papers with it. Ebay is correct to remove it, and I am supprized you have not been contacted by the federal Fish and Wildlife yet. They are serious about this law, as well as if you plan to sell waterfowl with paperwork, you had better have a Waterfowl license as well. You better find out about these laws if you plan on doing any waterfowl at all. Ignorance is no excuse when it comes to the law either. They live for easy busts like you. I hope all goes well, but get that license and the paperwork asap.
Getting the paper work after the fact could be bad for you as well. It also may get the breeder in trouble too.
Thanks roadkill ,I guess i'll just tear apart the mandarin and get the body and eyes back and file it under "experence".
Mandarin ducks are NOT on the list covering regulated migratory birds. They can be bought and sold with no papers needed. I hope that you haven't torn it apart yet! If you are going to mount ducks, geese etc. for other people, you need to get the fed. migratory bird permit. Read through the provisions that you get with it and keep your records sraight. You will find that mandarins are NOT covered in the list of regulated birds. Did you get a receipt from the seller? If so, use that to satisfy ebay's "paperwork". Or make your own "paperwork", to satisfy them.

Its in EBAYS rules. No they are not correct inpulling your bird as its not covered in the FED rules and regs.
No to sell any other mounted mig. waterfowl you must have the same permit as the rest of us do. $25.00 for three years.
All purchased birds, must be marked, by pinion, right rear toe clipped, or tattoed in the right foot web.
Get the permit and the regs and send Ebay a copy of the regs, show them they are wrong, unless California restricts the sale.

lawfully hunted. Migratory birds include all ducks, geese, hawks, owls,
crows and ravens. However, captive-bred, properly marked mallard ducks
may be sold if the seller clearly states in the item description that
the mallard duck was captive-bred. No other captive-bred waterfowl
species may be sold without permits obtained from the U.S. Fish &
Wildlife Service."
Although some of these birds may be legal to hunt and sell, the only
ones we allow on the site at this time are pen-raised Mallards.

Pinion or clipped wing is only one way of marking the birds, see my post above, straight from the CFR. Toe clipped or tattoed in the right web.
Maybe its time to e-mail EBAY a COPY of the regs.
Last I checked, The Chinese Mandarin duck is not considered Migratory in the United States and therefore, it it were me, I would classify it as Stuffed Birds which by eBay rules can be sold in accordance with state laws.
You just came into contact with a source at ebay that isn't familiar with the US fish and Wildlife laws and in thinking they were doing the right thing were actually wrong.
Post your bird again, and state in the description that the madarin duck is not native to North America and at this time is not subject to the same rules as migratory fowl. However, this is not the case for all foriegn species. So it doesn't hurt to go ahead and get the proper permits and become familiar with the do and donts.
If the breeder you bought the bird from however, isn't willing to provide you a transfer slip at your request, then I personally wouldn't do business with them. I've never had a breeder NOT give me a slip when I have asked for one. Truth being Mandarin's don't need one, they can still be useful for both you and the breeder when it comes to inventory,.
I saw your bird posted and I thought it looked quite nice. Definately a beginner bird, but hey.. I've seen much worse sell for much higher than what your reserve was. Keep up the work and you'll be surprised at where you can go. I personally sell more birds off eBay than I do on. But I have been known to suplement my income with the extra stuff I have left over in the freezer from time to time.

Hey man thanks for the complement on my bird.I learned a lot by doing it and would keep it but like i said im getting a little collection going here. the breeder i use is very nice and would have given me a permit if i needed one ,,,i just got back from his house and he gave me a federal list of birds and mandarin is not on it.
Also you said i can relist it as "stuffed"and its ok? Would it still be in the taxidermy section?
