Selling a Chickadee...

Submitted by David Grey on 03/10/2003. ( inhisgrip_247@yahoo.com ) 67.193.122.79

Are their laws prohibiting me from selling birds such as chickadees and woodpeckers? My parents have huge picture windows viewing bird feeders and I often get very nice specimins with no damage. I currently have a chickadee in perfect condition and I am curious as to whether I can sell it. If so, what would prices for such be?
Thanks,
Dave

Chickadees and woodpeckers are not part of the migratory bird act, althought they are still protected and have no open season so are not legal to have in your possession, and therefore illegal to sell..

So, thats a big NO.

Tell your parents to put those vinyl sticker-things (they cling by static electricity) on their windows so that they stop killing little birds!

Excuse me?

Mike, I must correct you. Chickadees and woodpeckers ARE part of the Migratory bird act. (I am going to assume we are speaking about birds in the US, but if not, please forgive me!) As I've said before, look at 50 CFR part 10. This is the list of birds covered by the act. It makes me crazy on here when people answer questions without looking up the answer or even knowing what they are talking about! You are correct in that they are still protected, many by additional State laws. However, they are protected by the migratory bird treaty act and you may not possess them, or sell them. It is a federal offense.

I stand corrected

Yes i was wrong, I went back and looked at the list and you are correct. I should either have left that out or went and looked before I spoke. I guess i always think of "migratory" when i think of 50 cfr, and Chickadees are not migratory or at least they dont leave Minnesota in the winter. Most woodpeckers are also not migratory. The point is that the only birds in north america that are not protected is the common sparrow and the starling. Correct me if im wrong.

Sorry for missleading you David.

The final answer to your questions is still no.
