Giving waterfowl

I just read in a post if you give waterfowl to another person you must deliver it personally. Is this true? Is it illegal for me to send a bird to a friend who is going to personally mount it for his own enjoyment?
Obviously the bird will be properly tagged for the transfer and no money or any such compensation will be given for the bird. Just a friend giving a species to someone who does not have that species in that area.

On the outside of the box, you must write what the box contains, use the latin name down in the corner. YOu already know the details who, where, when and "I gift this duck (latin name) to so and so."

Yes it would be better to hand deliver it but it is not needed. YOu can ship it and do all the samethings.

If there has been a law past that says ortherwise, someone needs to post line, verse where it is. for all to read.

According to the post that Nancy made wherein she copied it directly from the government website, not only must it be hand deliverred, it must be done so at your house or the house of the person giving it to you. In phone conversations I had with both the USFWS and CWS, they said there was no such thing as 'gifting' at all. Nancy copied and pasted the section specific TO gifting which does in fact exist, and in it, it says the gifting must be done "at the abode of the donor or donee". Translation; at one of your two homes according to the government website.

Now aint this great! Just the last couple of weeks I mentioned that I had a couple extra honkers and I would be willing to shipp them to fellow taxis under the presumption they are GIFTed.. Well a guy from Iowa wrote me and said he needed them because he was doing them for a donated display..I didnt get to it right away infact I put it off till I got back from Vacation..There was a phone message from a Jeff Korsmo of the powers county conservation office asking if I would still send him the birds and they would reinberse me for the shipping and how they still wanted the birds..Man am I glad I didnt fall for that line.. Now after reading this I soooo glad I didnt ..I was only trying to be kind ,friendly and helpfull ..The hell with that!
So heres to all you feds and dnr agents.Thanks for the education.. Good thing I didnt do what I thought was a good deed... So Now I have a question is it illeagel to send a mounted bird as a gift? Hummmm

Well strangely enough jeff just called me up he told me he isnt a office only works in the shop.. But he is going to look into this and see what if anything he can come up with intell from a state and fed on this.... I would hope there is a way to redo such a dumb law! If they are harvested right and theres no exchange of $$ and they are Gifted then why the hell not?
If this is so then I can think of a hundred post and exchanges I have seen on here and other site's stateing there gifting to one and another... What the hell how many times have beginners been given birds to learn on or another taxi been kind to any other?

50 CFR 20.40- Gift of Migratory game birds

No person may receive, possess, or give to another, any freshly killed migratory game birds as a gift, except at the personal abodes of the donor or donee, unless such birds have a tag attached, signed by the hunter who took the birds, stating such hunter's address, the total number and species of birds and the date such birds were taken.

There is no problem with gifting birds as long as they are properly tagged. This tagging can not be done in the field however.


50 CFR 20.40 says it!

I've done this tagging/note process at a boat ramp with a game warden watching on....to gift my ducks to a "duck hungry" crappie fisherman. Reading 20.40, the "unless such birds have been tagged ..." statement implies to me that it can be done anywhere. After all, the intent is to keep people from selling or killing more than a daily limit of ducks.

So it looks like it is illegal for me to send a bird form Alaska to Iowa, even if it is properly tagged. I assume it is not illegal to send a bird to a taxidermist to get mounted?

I am going to call the local F&W and see what the say.

After I re-read 50CFR 20.4 I looks like as long as I properly tag it it would be legal for me to send it. I read it too say that you do not need to tag it if it is given to another in one persons or the others home. Which would explain why it is legal to give waterfowl at a boat ramp as long you tag it. I read it a it must be tagged, except in the abodes of either party.
Please correct me if I am wrong.

I just got off the phone with our local USFW Department. Well, the person in charge of Migratory Birds did not have a clue and needed to check with others. This person had never heard of such a request. I just asked what I need to do to send a bird (migratory waterfowl) to a friend. I said it was my understanding according to 50 CFR 20.4 that I need it to tag it with the proper info and I would be fine. She was going to look in to it and get back to me.
I will let you know what she says.

Ok I got a call from Jeff today ,the guy who works in Iowa at the conservation office. He is sending me the signed statement from the feds that state's if the birds are tagged and listed so they can be sent gifted.. As soon as I get this I will scan it and post it on the kiwi chat or on here somehow.
I am pretty sure its the giveing ducks away at the landing thing,keeps ya from shooting another limit.. Whew I am glad I ma some serious full plumed birds coming form down south....

I just got of the phone with USFW and they checked with their people in the lower 48 and said as long as it is tagged and no money or services is exchanged everything is legal.
