ebay item... Great horned Owl from NY

Submitted by Craig on 2/15/05 at 10:52 PM. ( ) 66.66.226.122

# 7133589382 and I thought there were laws against this? If this is true I know a professor that would like to get rid of quite a few of these "older" mounts. He was told it was illegal under the CITES Act.

Just curious...I tried looking up the regs on selling older mounts like this but came up empty.

The owl's not for sale...

the piece of wood it's sitting on is what's for sale. I thought the same thing but the seller states in the ad that the bird goes along with the wood it's sitting on for free. Loop hole in eBay policy maybe?

Not Ebay policy...

that is being questioned here. It is the federal and state laws that come to mind.

Right, Right...

Right about the law thing. But just wondering if eBay saw it and figured it was ok since it was for "just the wood". Never know. Granted, I'm just a hobbyist, but even I figured there had to be some restrictions even on giving away the bird.

Hummm

<different situation>I was at a auction once. And in N.C. it is against the law to resell a matress and box springs. EVEN if they have never been used and still sealed in the plastic shipping bags, factory sealed tape and all. Well this auctioneer auctioned of a wore out broom and gave the bedding away for free. That wore out broom brought somewhere around 3oo dollars. But the winner got the king size beddings for nothing...LOL Just another loop hole. All though I would venture to say that I wouldnt attempt to sell a owl...oops I mean a mounting board on ebay! Probably be just alittle to much agrevation for me to deal with it. Especially if the high bidder was the Feds!
Good day to all,
Teddy

Not gonna work

If the owl is part of the base, it is still illegal, even if the person is selling the base and stating that the owl is free. Stay away from that one.

Who pays for the shipping?

The feds could nail them. They would have to ship the owl separate from the base at the cost of the party that is gifting it or its still illegal. We wouldnt get away with this.

Did Anyone Notice?

How he spelled owl? OWEL This could have been how he got away with it. Selling it on Ebay, that is. Ebay didn't catch it because of the spelling. Just a thought, these things don't last long on Ebay usually, they catch them and pull them off the auction.

Pre Act Bird

The "Burden of Proof" as to the age of this bird is on the USFWS. If they want to prosecute they would have to prove that it was originated after the 1972 Act was passed. I would never think of touching anything like this. A one time average person can probably get away okay. But a Wildlife Commercializing Taxidermist like me would get nailed to the wall and lose everything.............

You still cant sell them

This response submitted by Larson on 2/16/05 at 2:13 PM. ( ) 12.106.25.202

even if you have proof that they were taken before 1972.

I have this friend

Who is a Federal Fish and Wildlife Agent. He has spent some time in my shop and had pointed out some very interesting laws on this matter. One that really jumps out at me is that under the federal fish and wild life law you can not in any way sale, GIVE or gift any federal protected species of bird or water fowel. Some one could be in for some trouble if the wrong person see's that one. I was told there are many HIDDEN laws when it comes to protected birds. And that at any givin time. We taxidermists could be arrested just about any time we have some in our shops. Lucky for us the officers don't go out of there way on some of these sections. I have some of the inside laws that they use. If i get time I will look some stuff up that will be very handy to know. Nice some times being a cop for 15+yrs.

Hey Jack, email me if you would. I've been a cop about the same time and a part time taxidermist. Thanks.

My husband has been dealing with federal agencies for 13 years
busting illegal poachers, trappers and hunters. You cannot in anyway
sell or give away owls, hawks of any kind or buzzards, these are
federally protected birds. Must get a special tag from DNR. You must let them know or if they
find out they will nail you to a wall and lose everything you have
worked for. Is it worth it? Hope this helps. Good luck on a careful
decision.

What 1972 Act applies to a great horned owl?
