Where you go to...

Check where you go to register your own business name. For a fee they check to ensure that your name isn't already taken. In Ontario we can register a business name without this check - but if someone else already has it - it's the first person to register who has the rights to it.

Check with your states business licensing division. In Florida, ours has a website and you can go there to do a lookup on "fictitious names" to find out if the one you want is already registered. Floridas is www.sunbiz.org. Not sure if all stats have one or not.

Why open a business with a name that does not identify the
owner and/or operator? Why not use a name,ie,John Smiths' Taxidermy,or,Bob Jones Whitetail Taxidermy? This way, you should not have any problems such as using someone else's name.

Excellent point Russ

ALL states have a department of Revenue and all ficticious names have to be registered. Your bank won't do business with you without you providing proof of business registration. Many states even allow individual counties to contol such ficticious names and those counties maintain logs to prevent copyright and trademark infringements. IF you select a name of a national chain, be ready to hear their lawyers explain to you that their names are registered trademark names and your infringement on them will end up costing you money.

Look in the BLUE pages under "State Government" and look for "Department of Revenue" or "Prothonotary" or "Business Licensing". Any or all of them will help you in the right direction.

George, I have lived in two states that did not require that

Most banks only need your social security number and place of address. I just did that in the past six months when I moved. Yes I even talk to the SSA regional office.

It is not considered a ficticous name as long as there is proof of owners ID.

Smae states may have restriction, but its not specified within the Federal guideline. see SSA and IRS regulations.

here its called a DBA

Doing Business As. I chose to use my name in the biz name, as theres a bazillion wildlife, artist/artistry, mounting/mountin/mountain/man, trails end, whitetail, etc, names out there. I believe using your full last name in there does distinguish your business name from other names. A friend of mine points out using a generic name instead helps as a selling point should you ever want to sell. Heck, thats like an exit strategy! Im our state you must file for a dba before going into business. I can tell by many of the names out there that they arent filed, nor do they charge sales tax. Some outfits around will even report them. Personally, I dont care either way.
