You are taking about "implied" copywrite. However, how are you going to stop them from doing it. A 170 rack is hardly a monster in terms of what's avaiable in repos. You're talking about a repo that would sell for $100-200, not really worth bothering with if you want to copy it. What's it going to cost you to try and stop them should someone actually copy it?

...The original rack was NOT an original work of art. Thus any altering of the reproduction and then replication of that is probably legal. Copying the replica may not be a problem either depending on the assignment of the "right" to make the replica in the first place. Too many varriables in this situation, starting with the original rack and the "rights" to repilcate it. Alteration of an "original work of art" does not make it legal to copy the altered form either.
Make your copies, sell as many as you can. If someone copies your replica, so what. Neither you, nor they, are going to get rich. Other than for the practice and experience, the rack isn't large enough to bother with.
