There is a reason the Miranda states "Anything you say can be used against you in court". It doesn't say, what you say will help you.

 

How many of you puffing up your chests on the Internet would be willing to raise a fuss when it not needed when you realize you have to fork over the amount of the average new car to a lawyer to be defended? And they keep on sucking off you as the court appears get delayed and continue on. Are we as a profession rolling in that much cash? I know better. If you want to hemorrhage your hard earned money to make a point be my guest. I for one have better things to do than spend my money on sleazy lawyers that laugh all the way to the bank.

Now to be clear I didn't say to roll over if they get out of line. But if they come to check on me and do their job I say be my guest. I have nothing to hide.

Obviously you missed the part where simply because ONE TAXIDERMIST had the balls to stand up for his legal rights, you no longer have to worry about "paying a lawyer". The Showers case is now federal LAW. Even though your state does not fall into the same jurisdiction, the only way this does NOT apply in your area is if YOUR AREA is dumb enough to take this to the US Supreme Court. You can't name me a single lawyer who'd be dumb enough not to represent you for the 40%+ they'd make off the government in a case like this which is already CASE LAW.
I'm incensed at the idea that any person with a fraction of gray matter would ever make such a dumbassed remark as "I have nothing to hide". I would ask my self how anyone could be that stupid, but I keep seeing the same names pop up to prove it. If you fit into that category, I want you to go to YouTube and type in "Don't Talk to the Police" given by a professor of the Regent University School of Law, James Duane, who quoted US Supreme Court Justice Robert Jackson who served as the chief prosecutor at the Nuremberg Trials. Please pay close attention to the professor's comments on the wording in the LACEY ACT. I know Cecil is guilty.

I have had them stop by on a Sunday night when my shop wasn't even open and went up to the house and spoke to my wife, who is also a taxidermist. They waited about 2 hours in my shop for me to get home from out of town after speaking with her. Never had any issues, but as some have stated, there are times when you may not log something right away and it gets forgotten and it makes you nervous when they do arrive. I sometimes get lazy that way, not very often though; it is usually when I get a call to meet a customer after hours and its a customer I know well that doesn't have freezer space. I would get in the freezer and label the specimen but don't tag or get in the books necessarily. Then it may be a week before I'm back in my shop and sometimes stuff just gets forgotten. Honest mistake. I think it is sometimes the nature of the beast. As for my one time it was during Iowa deer season and we have a lot of poachers in southern Iowa. IMO they were looking for a specific deer or deer tag with a specific name on it because they had been tipped off. They checked several others in the area as well so it wasn't just me. From the rumor mill I heard they found a few deer they were looking for at a nearby shop that had already been mounted but not picked up. I don't think he got in any trouble other than removing the deer from the premises but I don't know. I try to do the right thing, and it would be an honest mistake if anything was not right with them. Like you all have said, they have a job to do, and so do I; 3 including taxidermy to be honest. Now that I am just doing this part time I am just trying to play catch up and likely am going to be a little more selective in what I take in. Freezers get full and I get bogged down with work and the military.

Not true if you have a Federal Migratory Bird License. That Federal Warden con look in the freezers and can legally get you out of bed to open them.

Sorry JL, not true. I spoke to the chief in Newtown about this. Federal officers CANNOT look into your freezers without a warrant. They can ONLY inspect your records and they must di it during "normal business hours". The chief did note that any work open to the public view is fair game to be included in the inspection.

elected officials, law enforcement and even some attorneys dont believe case law applies to them.
my old boss told me i didnt qualify for a LEOSA carry card. this card enables retired law enforcement to carry concealed in all 50 states. he said correctional officers dont qualify. we argued, he got the county attorney involved, the attorney took his side. i introduced case law from Pennsylvania, they both still said, it doesnt apply.
i got a lawyer, we threatened a suit in federal court...they caved, we won, i now have my LEOSA card.

case law rules, all others suck !!

when the DNR or any officer arrives for an inspection its your choice as what you allow them to do. no harm in doing so. but when they show up ordering you around and demanding things, you dont have to allow them to do anything beyond seeing your records. anything not in the open, they need a warrant, but then again, thats up to you too.
