Art. 572. Limitation of prosecution of noncapital offenses

A. Except as provided in Articles 571 and 571.1, no person shall be prosecuted, tried, or punished for an offense not punishable by death or life imprisonment, unless the prosecution is instituted within the following periods of time after the offense has been committed:

(1) Six years, for a felony necessarily punishable by imprisonment at hard labor.

(2) Four years, for a felony not necessarily punishable by imprisonment at hard labor.

(3) Two years, for a misdemeanor punishable by a fine, or imprisonment, or both.

(4) Six months, for a misdemeanor punishable only by a fine or forfeiture.

B.(1) Notwithstanding the provisions of Article 571.1 and Paragraph A of this Article, prosecutions for any sex offense may be commenced beyond the time limitations set forth in this Title if the identity of the offender is established after the expiration of such time limitation through the use of a DNA profile.

(2) A prosecution under the exception provided by this Paragraph shall be commenced within three years from the date on which the identity of the suspect is established by DNA testing.

(3) For purposes of this Article, "DNA" means deoxyribonucleic acid, which is located in cells and provides an individual's personal genetic blue print and which encodes genetic information that is the basis of human heredity and forensic identification.

(4) This Paragraph shall have retroactive application to crimes committed prior to June 20, 2003.

C. Upon expiration of the time period in which a prosecution may be instituted, any bail bond applicable to that prosecution which bond has not been forfeited shall also expire, and all obligations of that bail undertaking shall be extinguished as a matter of law.

SUBPART C. BY MISAPPROPRIATION WITHOUT VIOLENCE

§67. Theft

A. Theft is the misappropriation or taking of anything of value which belongs to another, either without the consent of the other to the misappropriation or taking, or by means of fraudulent conduct, practices, or representations. An intent to deprive the other permanently of whatever may be the subject of the misappropriation or taking is essential.

B.(1) Whoever commits the crime of theft when the misappropriation or taking amounts to a value of one thousand five hundred dollars or more shall be imprisoned, with or without hard labor, for not more than ten years, or may be fined not more than three thousand dollars, or both.

(2) When the misappropriation or taking amounts to a value of five hundred dollars or more, but less than a value of one thousand five hundred dollars, the offender shall be imprisoned, with or without hard labor, for not more than five years, or may be fined not more than two thousand dollars, or both.

(3) When the misappropriation or taking amounts to less than a value of five hundred dollars, the offender shall be imprisoned for not more than six months, or may be fined not more than one thousand dollars, or both. If the offender in such cases has been convicted of theft two or more times previously, upon any subsequent conviction he shall be imprisoned, with or without hard labor, for not more than two years, or may be fined not more than two thousand dollars, or both.

C. When there has been a misappropriation or taking by a number of distinct acts of the offender, the aggregate of the amount of the misappropriations or taking shall determine the grade of the offense.

Let me tell you what I REALLY hope. I hope Harry [expletive deleted] up with his data entry. That's what I REALLY hope for. And if he did, I will be the first in line to blast Harry's ass and YOU know that, and so does Harry. I think everyone knows by now that I have a great love, respect and admiration for John Janelli. I also find it hard to believe that Joe Kulis would do this. I want the TRUTH. I am so sick and tired of the back stabbing, the innuendo's, the suspicions, the lack of trust, the sarcasm, the hateful e-mails and pm's that go flying around the net. Do YOU think I want to do this? HELL NO! Believe it or not, I do have better things to do. But I feel like the pivot man in the middle of a circle jerk, and I DON"T like it. I'm man enough to stand before whatever public perception comes my way, but I'm also man enough to admit when I'm wrong. How can I be wrong for wanting the TRUTH? Don't YOU want the truth? The ONLY thing that is ever going to make all this chit stop is the truth. Anything short of that is going to keep the NTA in the muck. A place where some I think prefer it to stay. I'm not one of those people. Now let's clear it out of the muck once and for all and let's get on with our lives. But until that is done, I won't stop. I can't. If I did, I would be no better than those who allowed the Crain's to do what they did to the NTA. Everyone has said, bring on your polygraph, bring on your investigation. I have NOTHING to hide. Then so be it. Let's get it out there and let's deal with it. I pray to God none of my friends are dirty in this. But until this is put to rest, the public opinion of the NTA and it's leaders will NEVER be what it should. Yes, I'm pissed about how the settlement with the Crain's went simply because it could have been avoided. But that it water under the bridge now. The Crain's are gone. This black eye currently being talked about needs resolved. You yourself said; this will get swept under the rug like things in the past. NOT if I can help it. I will not stand for this to get swept under the rug. Now I don't know what more you want, but the OFFICIAL NTA statement that John Creager posted should be enough to tell you that they recognize that 9575.00 is missing as per the financial statements. So where did it go? Clerical error? Theft? Who knows at this time? Surely I don't, and neither does anyone else. But to not dig into it would be ludicrous, and the last straw for the NTA. If everyone is innocent, then let's clear their names, once and for all because I'm sick of it. If you, the public, or the officers of the board feel that getting the air cleared is wrong, then I'm not the one who is wrong. You, they are. I'm not looking for a fight. Only the truth and let's get this organization either up and running like it was meant to be, or let's put a dagger in it and be done with it, once and for all. Remember, it was you who gave up on trying to salvage what's left of the NTA. Not me. But if you want me to go away, just say so. I'll be gone in a flash because I don't care either way personally. I only do what I do for those who dreamed it could all be fixed and righted. If you don't want me trying, then just say so, and I'll lighten my load as you described it.

I understand perfectly Harry, and I know you are not wrong. But knowing that, and proving that is two different things. It is not my job to prove it. It is yours. Just the same as it will be on those who handled the money. So have a good weekend...everyone, and let's just let the process take place. There is nothing more for any of us to do at this point until we get to that damn convention.


George, it is my understanding that there were those who pressed for Archie's removal, but not one of his accusers would testify to the fact. So what are you to do? Have another suit to deal with?
